Commercial Litigation - Enforcement - Another successful dispute of enforcement proceedings based on a Bill of Exchange
The office represented a major local company and a business owner (guarantee debtor) on bill of exchange claim for various credit facilities that were alleged to have matured.
In the past year, the office has had a major increase in representing clients in relation to enforcement proceedings based on various security forms - whether in the shape of bills of exchange, letters of credit, guarantees, or proprietary security.
In the current matter, the office represented the clients in the enforcement proceeding instigated by a foreign commercial bank looking to enforce a bill of exchange for an amount of 3,5 million EUR.
The office successfully disputed the formal reasons for the enforcement and dispute the basis of the claim by the financial institution, and the claim was forwarded to the relevant Civil Court for a full trial.
