For a period of two years, the firm supported the client and coordinated the multijurisdictional legal team on various aspects of the case. 

Following multiple submissions, forensic analysis, internal and external investigative work by advisors, and negotiations with the authorities, the client obtained a favourable settlement and non-prosecution decision in relation to the entire case.

Commercial Court – successful representation in a 5+ mil. EUR shareholders’ dispute over a TMT sector joint venture

The firm has successfully represented a corporate client and a majority shareholder over a 5 mil. EUR lawsuit filed based on a shareholders’ agreement concerning a joint venture in a TMT sector company.

Initiated in 2019, the claim was dismissed in the first instance in 2022 by the Commercial Court and confirmed as final by the Commercial Court of Appeal recently. In a complex factual matrix spanning a long number of years of the joint venture and grappling with various arguments on the interpretation of the agreement between the relevant parties, the firm succeeded in arguing that the obligations to pay certain sums never arose and defended the respondents with respect to their alleged joint liability.  Full costs have been awarded to the respondents.

 

 

 

 

Successful dismissal of a large technology sector tax case

The firm acted for multiple defendants in a high-value tax investigation concerning certain asset transfers and licenses in the cross-border technology space. The investigation, which was regulatory in nature, was also handled by the Basic and High Prosecutor’s Office due to allegations of criminal tax evasion and money laundering. Following the challenge of the various allegations of the authorities, and addressing the complex factual matrix which prompted the authorities to initiate the case, the firm successfully acted for the parties and achieved a dismissal of the investigation.  In addition to the Serbian law, the case also involved offshore jurisdictions and international taxation matters.
